New Guardianship Laws Take Effect December 1, 2006
- The Wisconsin Legislature has passed a major changes to the Wisconsin guardianship laws. These changes take effect on December 1, 2006. They will have a major impact on how we will attempt to protect our most vulnerable neighbors and family members. Among the changes are:
- The statute has been reorganized so it is easier to find things that you are looking for.
- The rules on determining incompetency have been changed so that guardianships will be more limited and targeted to meeting the needs of particular individuals. In many cases, guardianships may be replaced by less intrusive methods to help.
- Instead of a guardianship taking away all rights, it will only take away those rights specified by the court.
- The duties and responsibilities of guardians have been spelled out and clarified.
- There are now sanctions and penalties for guardians who do not do their job.
